Welcome to Find it! These Terms of Service (“Terms”) govern your use of the Find it Shop Mini (“Mini,” “Service,” “we,” “us,” or “our”) operated by CET TECH LLC within the Shop app.

By accessing or using Find it, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Mini.

1. Acceptance of Terms

By using Find it, you affirm that you are at least 13 years of age and capable of entering into a binding agreement. If you are using the Mini on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Find it is a gift recommendation service that helps users discover products based on their preferences and requirements. Our Mini provides:

• Personalized gift recommendations through an interactive quiz
• Product search and filtering capabilities
• Integration with the Shop app’s commerce features
• Search history and saved preferences

3. Shop App Integration

Find it operates exclusively within the Shop app. Your use of Find it is also subject to:

• Shop’s Terms of Service
• Shop’s Privacy Policy
• Terms and conditions of individual merchants

We are not affiliated with, endorsed by, or officially connected to Shop, except as a Mini developer within their platform.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate and truthful information when using our quiz and search features. While our recommendations are personalized, they are suggestions only and may not always meet your specific needs.

4.2 Appropriate Use

You agree to use Find it only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Mini in any way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the Mini’s functionality
• Use automated systems to access or scrape data from the Mini
• Reverse engineer, decompile, or disassemble any part of the Mini
• Use the Mini to transmit harmful code, viruses, or malware
• Impersonate others or provide false information
• Harass, abuse, or harm others through the Mini

5. Recommendations and Product Information

5.1 Nature of Recommendations

Our gift recommendations are provided for informational purposes only and should not be considered as professional advice. Recommendations are generated based on the information you provide and may not be perfect for every situation.

5.2 Product Information Accuracy

We strive to display accurate product information, including prices, descriptions, and availability. However:

• Product information is provided by third-party merchants and the Shop app
• Prices and availability may change without notice
• We do not guarantee the accuracy of product descriptions or images
• Actual products may differ from their descriptions

5.3 No Purchase Obligation

Viewing recommendations through Find it does not obligate you to make any purchase. All purchasing decisions are entirely at your discretion.

6. Intellectual Property Rights

6.1 Our Rights

The Mini, including its design, features, algorithms, and content, is owned by CET TECH LLC and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Find it for personal, non-commercial purposes, subject to these Terms.

6.3 Trademarks

“Find it” and our logo are trademarks of CET TECH LLC. You may not use these marks without our prior written permission.

7. Disclaimers and Limitations of Liability

7.1 “As Is” Service

FIND IT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of recommendations
• Warranties that the service will meet your expectations

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CET TECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data or information
• Business interruption
• Personal injury or property damage
• Loss from purchases made through recommended products

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF FIND IT SHALL NOT EXCEED $100 USD.

7.3 Third-Party Transactions

We are not a party to any transactions between you and merchants. We are not responsible for:

• Product quality, safety, or legality
• Merchant’s ability to fulfill orders
• Shipping, delivery, or returns
• Customer service issues with merchants
• Disputes between you and merchants

8. Indemnification

You agree to indemnify, defend, and hold harmless CET TECH LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of Find it
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

9. Privacy

Your use of Find it is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Modifications to Service and Terms

10.1 Service Changes

We reserve the right to modify, suspend, or discontinue Find it (or any part thereof) at any time, with or without notice, for any reason.

10.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms within the Mini
• Updating the “Last Updated” date
• Providing notice through the Shop app (for significant changes)

Your continued use of Find it after changes become effective constitutes acceptance of the updated Terms.

11. Termination

11.1 Termination by You

You may stop using Find it at any time by uninstalling the Mini from your Shop app.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to Find it at any time, with or without cause or notice, if we believe you have violated these Terms or engaged in inappropriate behavior.

11.3 Effect of Termination

Upon termination:

• Your right to use Find it will immediately cease
• We may delete your saved preferences and search history
• Provisions that by their nature should survive termination will continue to apply

12. Geographic Restrictions

Find it is available only where the Shop app operates. We make no representations that the Mini is appropriate or available for use in all locations. If you use Find it from outside permitted jurisdictions, you do so at your own risk.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13.2 Arbitration Agreement

Any dispute arising from these Terms or your use of Find it shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ARBITRATION, CLASS ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

13.4 Exceptions

Notwithstanding the arbitration provision, either party may seek equitable relief in court for infringement or misappropriation of intellectual property rights.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CET TECH LLC regarding Find it.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and CET TECH LLC as a result of these Terms or your use of Find it.

14.6 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.

15. Feedback and Suggestions

We welcome your feedback! If you provide us with suggestions, ideas, or feedback about Find it, you grant us the right to use and implement such feedback without any obligation to you.
